Despite an industry upheaval and two gravely ill sons, this health-care entrepreneur discovered the prescription for perseverance. Sadly, looming business woes were the least of the Langdons worries that year. In the summer of 1996, at age three, their son Spencer–twin brother of Tyler–was diagnosed with leukemia, warranting three years of chemotherapy and approximately $1,000 worth of medication each month. Faced with circumstances that would obliterate the future goals of most, the Langdons didnt fold, but instead expanded ATPs services to override the Medicare massacre. Making ATP a onestop shop by adding outpatient rehab to its services was the ultimate goal, but first the Langdons had to move the company out of their Carrboro, North Carolina, home (situated in a bedroom, no less) and into a Hillsborough, North Carolina, office complex. To Ted, outpatient was ATPs salvation. I really started seeing the effects [of the Balanced Budget Act] in 1997, says Ted, 33. Medicare-based agencies were laying off staff, and the first people to go were with contract companies. If they didnt go Out of business or merge with other corporations, agencies drastically reduced their pay rates to contract companies, lowering the therapists wages. Some just didnt pay at all–like House Calls, a statewide home-health agency in North Carolina whose owner was nabbed for allegedly double-billing his way to Medicare/Medicaid fraud in 1997. I tried everything I could to retrieve [the $14,000 House Calls owed], but they were sued by everyone, says Ted. They had everything frozen, and I wa s so far down on the lawsuit list that, basically, I never got paid.

In a personal injury action, defendant sought a partial summary judgment in Fellenz v. Luedtke Engineering Co. U.S. Magistrate Judge Jonathan W. Feldman denied the motion due to the fact that New York case law is not clear on applying Labor Law Section 241(6) to the type of work plaintiff was doing, nor is it clear that the observable danger would absolve defendant from liability under Section 200 of the Labor Law.Plaintiff Fellenz was employed by the Army Corps as the projects construction inspector and representative. His duties included observing the progress of the work, insuring that the break wall construction met specifications, completing quality assurance reports and plotting drawings. Fellenz was present on the construction site daily from June 1996 through May 1997.
It is almost worthwhile getting “whiplash” preprinted on a claim form to save time Turning first to the real increase, the recently published report by the governments Statistical Service on Road Accidents in Great Britain in 1996 provides a clue. Injuries in 1996 totalled 317,000, which was an increase on the 307,000 in 1995. Fatalities, however, fell slightly to 3,598 from 3,621. Both figures had been generally falling since the mid 60s, when they peaked at just under 8,000 fatalities and just under 400,000 injuries. This has doubtless arisen for a whole number of reasons, including compulsory seat belts and crash helmets, drink drive regulations, air bags, better car design, and many others. To achieve this reduction over that period was particularly remarkable, because the vehicle population in the mid 60s was 13 million compared with slightly over 26 million now. Most of this increase in vehicle population can be found on the M25 each morning and evening!
Over 1,700 cases have been lodged this month alone - which is twice the number that was lodged in the same 21- day period last year.

If anyone should be an inspiration to the legions of non-Latin Europeans dutifully signing on for GCSE salsa classes, Larry Harlow should. Jewish, and the son of a band leader and an opera singer, Harlow veered abruptly towards Latin street music, rather than jazz or the classics at the Music Art High School in New York in the 1950s. “We were right beside Spanish Harlem - I used to listen to the music in the Latino grocers shops.” In the 1960s and 1970s his novel rearrangements of trombone, trumpet, violin and flute sections moved him to the centre of New Yorks Latin scene, working with artists like Johnny Pacheco, Ray Barreto and Willie Colon, the generation whose tough new hybrid sound first came to be called salsa. Harlow was the first artist to be signed by the seminal Fania label, co-wrote the Latin rock opera Hommy (Mark 2 version on the way), played for the famous Mohammed Ali-George Foreman fight in Zaire (a fiasco: everyone came for the fight, not the concert). The last decade has been spent with his own band touring the world. Last year conga ace Ray Barreto had the idea, inspired by the “fantasy band”, an ad hoc group of jamming jazz stars, of reconvening Harlow, himself, singer Adalberto Santiago and cuatro player Yomo Toro as the Latin Legends Band. Thus Harlow makes his first ever London appearance on Saturday (Barreto is a regular performer and Santiago was here last year). No longer a breath- bating prospect, perhaps, but a most intriguing one.

The world faces a formidable challenge: How can water be provided to meet the worlds ecological and human needs? One-sixth of the worlds population has inadequate access to safe drinking water and many have inadequate water for food production. As populations increase and as unsustainable practices reduce and degrade water supplies, competition for water and the potential for local, national, and international conflicts over water will increase. Water is a finite natural resource that exists in a constant quantity on the earth. But is that quantity sufficient? The global supply of water is estimated to be 206 billion L (54 billion gal) for each one of the worlds nearly 6.7 billion humans. Unfortunately, 97 percent of this water contains excessive dissolved solids, and without treatment, it is unusable by most plants and animals. This leaves 5 billion L (1.3 billion gal) of fresh water per person. Of that, more than two-thirds is frozen in ice caps and glaciers and not readily available. That still leaves about 1.6 billion L (1.4 billion gal) of fresh surface and groundwater for each person on the planet. Assuming that per capita usage of fresh water is 2 million L (0.5 million gal) per year an estimate for personal, agricultural, and industrial use in industrialized countries–human needs would require only one-eighth of one percent of the fresh water available. This suggests there is plenty of water; unfortunately, it is not well distributed, and therein lies the problem. Agricultural and biological engineers have and will continue to provide the engineering to economically and sustainably capture, treat, distribute, and efficiently use available water to meet local needs. However, local supplies are often simply insufficient.

Websters further states that cellulite is a non-medical term. In other words, it is not a real condition, but a social comment. The diet itself contains no magic potions or fat-burning combinations of foods. It is a very low-fat diet providing 1,000 to 1,300 calories a day. The diet is probably too low in fat (6% to 20% of calories) for most dieters to stick with for long. In fact, the book recommends that the diet be followed for only 28 days; after that a higher calorie maintenance plan is begun. Forty-five low-fat recipes are provided as well as a brief listing of foods and their calorie and fat contents.
Scientists at Archet Hospital, (3) in Nice, France conducted a study to identify the characteristics of cellulite in women of different ages and to learn if cellulite could interfere with aging. They reported that population with cellulite presents earlier stage ageing characteristics than the control population. Well this association is intriguing because how could localized cellulite induce overall skin ageing? I think more research will provide additional information. Preventing cellulite is impossible, yet there are numerous cosmeceutical and medical approaches for its treatment.

The low levels of sodium pentobarbital that dogs might receive through their food are unlikely to cause any health problems, according to an FDA study. During the 1990s, the FDAs Center for Veterinary Medicine (CVM) received reports from veterinarians that pentobarbital seemed to be losing its effectiveness for anesthesia in dogs. Based on these reports, the center decided to investigate the theory that the dogs were exposed to pentobarbital through dog food, and that this exposure was making them less responsive to pentobarbital when it was used as a drug. CVM developed and used a sophisticated process to detect and quantify minute amounts of pentobarbital in dog food. Upon finding pentobarbital residues in some samples of dry dog food, CVM scientists conducted further tests that led them to conclude that dogs eating dry dog food are unlikely to have any adverse health effects from the low levels of pentobarbital found in the dog food samples tested.
Its a dogs life, and its even harder than we thought. African wild dogs need so much energy during a day–more than twice what some scientists had thought–that losing just a quarter of their food to thieving hyenas may threaten the dogs survival. Martyn L. Gorman of the University of Aberdeen in Scotland and his colleagues, who have taken the first energy measurements of these dogs in their natural habitat, report the findings in the Jan. 29 Nature.
This launch constitutes a strategic move as 45% of French families own at least one dog or cat, of which there are about 17 million. Chilled pet-foods are, however, non-existent in France, and this is likely to create a new niche in the F3,000m petfood market in France.

They argue that, if marijuana, cocaine, heroin, and other drugs were legalized, several positive things would probably occur: (1) drug prices would fall; (2) users would obtain their drugs at low, government-regulated prices, and they would no longer be forced to resort to crime in order to support their habits, (3) levels of drug-related crime, and particularly violent crime, would significantly decline, resulting in less crowded courts, jails, and prisons (this would allow law-enforcement personnel to focus their energies on the “real criminals” in society); and the drug production, distribution, and sale would no longer be controlled by organized crime, and thus such criminal syndicates as the Colombian cocaine “cartels,” the Jamaican “posses,” and the various “mafias” around the country and the world would be decapitalized, and the violence associated with drug distribution rivalries would be eliminated. By contrast, the anti-legalization camp argues that violent crime would not necessarily decline in a legalized drug market. In fact, there are three reasons why it might actually increase. First, removing the criminal sanctions against the possession and distribution of illegal drugs would make them more available and attractive and, hence, would create large numbers of new users. Second, an increase in use would lead to a greater number of dysfunctional addicts who could not support themselves, their habits, or their lifestyles through legitimate means. Hence crime would be their only alternative. Third, more users would mean more of the violence associated with the ingestion of drugs. These divergent points of view tend to persist because the relationships between drugs and crime are quite complex and because the possible outcomes of a legalized drug market are based primarily on speculation. However, it is possible, from a careful review of the existing empirical literature on drugs and violence, to make some educated inferences.

INTRODUCTIONIn marine environments, introductions are also common and damaging (Carlton 1987, 1989, Zibrowius 1991), but efforts at pest control have been limited to conventional pesticides. Recent studies on mechanisms of transport and establishment indicate that ballast water, as a larval conveyance, is the most important means of dissemination (Carlton 1985, 1989). Since most such introductions arrive as larvae, they generally come free of natural enemies (parasitic castrators, specialized predators, and pathogens of adults) that might normally control their abundance in their native regions (Lafferty and Kuris 1994). The resultant, extremely high population densities attained by alien species is what usually leads to economic damage (Nichols et al. 1990).There have been several recent calls for research on biological control of marine pests (Miller 1985, Moyle 1991, Buttermore et al. 1994, Lafferty and Kuris 1994). Australias CSIRO (Commonwealth Scientific and Industrial Research Organization) Division of Fisheries has recently taken the lead in marine pest problems by establishing the Centre for Research on Introduced Marine Pests (CRIMP) in Hobart, Tasmania. CRIMP plans a pro-active approach to marine pests in the style of Australias historically aggressive and innovative use of terrestrial biological control. To stimulate further dialogue on control of marine pests, particularly introduced species, we first briefly consider some marine pests in U.S. waters. We illustrate the highly diverse nature of these pests and focus on the type of damage they cause and on considerations for their control. The heart of our paper contrasts the general nature of marine vs. terrestrial pest control, and we provide some guidelines for the adaptation of existing biological control strategies to the unique challenges of the marine environment. Finally, we present a case study of the introduced European green crab, Carcinus maenas. Since this has been recognized as a serious pest and is a well-studied animal, we outline a general approach to its control.

A trip in a stretched limousine has rew- arded Fartown High School pupils. Six students were given the special trip for having a 100% attendance record in the school year and for improving behaviour. The students were driven from school to Scammonden Water, where they enjoyed games and a picnic. The initiative was org- anised by teacher Joanne Carter and project worker Sarah Clarke.

> Webb Furniture of Galax, VA, announced it will close its bedroom furniture plant and lay off more than 300 employees. Webb Furniture President Lee Houston attributed the companys competitive problems to Chinese furniture imports. Webb Furniture was a founding member of the American Furniture Manufacturers Committee for Legal Trade, which successfully challenged for antidumping duties against Chinese wooden bedroom furniture makers.
Three days after furniture-makers filed a petition seeking the imposition of antidumping duties of Chinese wood bedroom furniture, the CEO of Furniture Brands International, one of Americas largest furniture manufacturers, vowed to fight against it. Joe Dorn, of the Washington, DC, law firm King Spalding, represents the coalition and union. The day of the filing, Dorn said, The petition presents very compelling evidence of the serious injury suffered by the U.S. wood bedroom industry and its workers from a surge of unfairly priced imports from China. The petition states, Dumped imports were equal to 44 percent of the value of domestic production and 23 percent of the value of apparent domestic consumption in 2002. During January to June 2003, it says, dumped imports were equal to 67 percent of domestic production and 30 percent of apparent consumption. It also contends (The) petitioners net sales value decreased by 23 percent from 2000 to 2002, and by another 24 percent from the periods January to June 2002 (and) January to June 2003.
MFI YESTERDAY blamed a dire end to its key winter sale for plunging like-for-like sales at its core UK retail business. The furniture group, which just three weeks ago guided the market to expect sales to recover, said its “outdated” bedroom ranges had put customers off buying its products. Its shares plunged 3 per cent to 140p. Like-for-like sales across its UK estate fell by 4 per cent from Boxing Day to 21 March, exacerbating the 3 per cent decline that the group reported last month. David Jeary, at Credit Suisse First Boston, said same-store sales must have fallen by 6 to 7 per cent in March, against the managements hopes that they would be flat against the previous year.

HEALTH Secretary Alan Johnson ordered an inquiry today into why many people still do not have access to an NHS dentist despite billions of pounds of investment. Experts have been drafted in to identify obstacles to seeing a National Health dentist in many areas of the country. The move follows continued criticism that the number of people seen by NHS dentists has fallen steeply since a controversial overhaul of services. Some 1.2 million fewer patients visited dentists in the two years to June than in the period before new contracts were introduced.
Insurance cover for dentists in the North East is to be made compulsory in efforts to protect patients. All dentists will have to take out full indemnity cover before registration as part of new powers for the General Dental Council (GDC), Health Minister Rosie Winterton announced. This will mean that dentists in the region who are found to have harmed patients are insured and able to pay compensation.
TWO new NHS dentists are set to be recruited in Whitley Bay. The move is as part of pounds 300,000 investment by North Tyneside Primary Care Trust to improve access to NHS dentistry in the borough. Details on how patients will be able to access the services will be announced once the dentists have been appointed. Chief executive Chris Reed said: Im really pleased to announce this additional investment in NHS dentistry for North Tyneside.

The Missouri Supreme Court upheld the rights of municipalities to collect subdivision and maintenance bonds from developers in a case that pitted the city of Wildwood against the Home Builders Association of Greater St. Louis. The General Assembly amended Section 89.410 in 1999 by enacting Senate Bill 20. As amended, Section 89.410.2 allows the city council to accept a bond “in an amount and with surety and other reasonable conditions, providing for and securing the actual construction and installation of the improvements.” The pre-amendment statute referenced “conditions satisfactory to it” rather than “other reasonable conditions.” In addition Section 89.410.3 requires cities to release any escrow amount within 30 days of completion of each category of improvement or utility, although cities may retain 5 percent to release when all improvements and utility work has been completed. According to Vogel, the Home Builders Association of Greater St. Louis proposed the 1999 amendments, but when municipalities changed their ordinances to conform with the amended statute, the HBA sued. In the case at hand, the HBA brought a declaratory judgment action against Wildwood challenging the validity of the city ordinance that requires the posting of bonds for subdivision improvements.
Now that Baby Bullet express service is off and running in the San Francisco Bay Area, Caltrains engineering and construction team is turning its attention to other improvements, such as upgrading station amenities and making stations safer and more accessible. Caltrain recently kicked off the next phase of construction on the first maintenance facility in Caltrains 142-year history. During the coming year, crews will complete the construction of the $140-million facilitys tunnel and will begin work on the repair shop, which will increase the speed of repair work, storage tracks with ground power and a new indoor train washer, which will replace the portable machine now in use. Currently routine maintenance is done at a small, outdated train yard in San Jose and at the San Francisco station. Construction crews are in the midst of digging a pedestrian tunnel, which will allow workers to move between the shop and a new operations building. The construction of the maintenance shop should begin this Summer. The final phase of CEMOF is the construction of a new three-story operations building and one-story control facility, which will accommodate train dispatchers and other key staff.
A U.S. Senate vote on the Defense Department authorization bill, including more than $56 million for military construction and maintenance in Oklahoma, has been set aside for Congress to focus on budget and tax matters. Under the bill, Fort Sill would receive the biggest chunk of the state appropriations, with $25 million for barracks rehabilitation. The bill includes $9.6 million for work on the B-2 software maintenance facility at Tinker Air Force Base and $11 million for land acquisition at Altus Air Force Base. Vance Air Force Base would receive $6.7 million for a base engineering complex. Will Rogers World Airport would gain funding for three construction projects for the Oklahoma Air National Guard unit, including $3.1 million for an aeromedical training facility, $497,000 for barracks and $350,000 for a base supply complex.

The British Industrial Truck Association says that the market for forklift trucks was still high at the end of the first quarter of 2001. The market for counter-balance trucks fell from its peak of 15 263 units in October 2000 to 14 797 units at the end of the first quarter this year, it is still at a high level. The number of orders for this type of truck fell by 12.6% compared to the same period last year. BITA data for the first quarter shows that overall there was a decline of 2.9% in the number of orders for powered trucks placed compared to 2000.

Over the past 10 years, many of the worlds most popular brands have expanded their footholds in Latin America. The market in Mexico alone grew 20% last year, well over the world average of 10%, says Schmidt, who officially represents the trade organization Asociacion Mexicana de Franquicias. In 1988 a local dispute in East Hampton Long Island received national attention. An affluent couple was threatening to sue their town for refusing them a permit to build a second swimming pool at their ocean-front home. While the dispute hinged on issues of zoning restrictions and environmental protection the story was widely reported due to its almost comical justification of Thorstein Veblens 1899 critique of the “leisure class.” If one backyard pool is an emblem of comfort and leisure two pools at an ocean-front home exemplify conspicuous consumption run amok.At the same time a different sort of swimming pool controversy was raging in Greenspoint New York. Residents of this Brooklyn neighborhood bitterly disagreed about what should be done with the crumbling remains of the McCarren Park municipal pool. Some in the community especially the Latino and African American residents wanted the pool restored to its former splendor. Built in 1936 this enormous pool which could accommodate 6800 swimmers at a time had served as a recreation resort for locals unable to afford memberships at private pools and according to a New York Times writer had been “the hub of the working-class neighborhoods summertime social life.” Other area residents most of whom were white wanted the pool closed permanently or rebuilt on a much smaller scale. They feared that such a large public pool would become a locus for urban crime.

The economics of demand, price elasticity, risk aversion, and the effect of insurance on the demand for medical services are explained clearly and well. Behavior of suppliers in the medical care market is reviewed, with attention given to differences in for-profit and not-for-profit organizations. A solid explanation of competitive markets allows discussion of timely issues such as the limits of applicability of the competitive model to the medical care market, price and nonprice competition, and market power of providers, purchasers, and patients. Outside readings on current managed competition proposals would augment the textbook discussion well.A short section on the economic effects of information asymmetries in the medical care and health insurance market introduces the concepts of supplier induced demand and adverse selection. Both discussions are short, but the portion on adverse selection especially needs expansion. More rigor, explanatory graphs, and a more extensive bibliography would make the adverse selection concept more useful. This topic is critical to a sound understanding of the functioning of medical expense insurance.The final section deals with value judgments and evaluative economics. The nontechnical explanation of efficiency versus fairness criteria for evaluating medical care policy is somewhat cursory. More technical material is needed to improve the precision of this discussion. However, even without any additions, the text provides a general background on issues of access to medical care, affordability, and quality of care. The difficulty of making allocation decisions given scarce resources is clearly laid out and opens the way for a discussion of policy alternatives.

Utahs foreclosure rate has dropped to its lowest point in nearly eight years, and 30 states now post higher rates than Utah, according to a new report. For the three months ended June 30, the percent of mortgage loans in foreclosure in Utah fell to 0.74 percent, down from 1.18 percent in the same quarter of 2005, according to the Mortgage Bankers Associations delinquency survey. The last time Utahs foreclosure rate was lower was in the fourth quarter of 1998, when the rate was at 0.70 percent.

Thats well ahead of the 40 foreclosures at this time last year, according to the La Crosse County Sheriffs Department. Of the 52 completed foreclosures in La Crosse County so far this year, 28 were in La Crosse, 10 in Onalaska, six in Holmen, five in West Salem, two in Bangor and one in Coon Valley.
