The craze for litigation based on whiplash - neck - injuries lasted through the Sixties and Seventies. Insurance companies paid out billions of dollars to claimants who were inventing their injuries entirely or, at best, creatively exaggerating them. But the whiplash phenomenon was just one small part of an unpublicised American industry: a criminal underworld devoted to the faking of personal injuries. This is not a book about a few slippery lawyers and doctors conspiring with greedy accident victims to talk up their symptoms and prognoses in order to exact additional compensation. Those scams exist but are the small beer of the trade. What Ken Dornstein describes in Accidentally on Purpose is a veritable gangland of ruthless, sophisticated operators using modern methods to defraud insurance companies out of huge sums. Here is one example: the “capper” is the planner, the choreographer, whose job is to stage an accident that will look like the real thing and lead to multiple claims. He hires “dummies”, the victims, often poor Hispanic immigrants. For as little as $100 each, they will pack into a car (”the squat car”) that they know will be involved in an accident. The capper then hires a specialist driver whose job is to provoke an innocent trucker into crashing into the squat car. The logistics are carefully planned: where, when and what kind of impact is required. The accident achieved, the dummies file their injury claims with the help of dishonest lawyers. Of course, they dont receive a cent of the proceeds. Occasionally, the staging goes wrong and the dummies are hurt badly or even killed. Recently, an attorney who masterminded these “swoop-and-squat” operations was indicted for his part in the death of a passenger in a squat car. Dornstein started his career as a private investigator in Los Angeles, looking into suspicious accidents. His book describes dozens of varieties of contemporary scams. But his exhaustive historical trawl is even more intriguing. The sheer imagination and expertise of some past fraudsters is impressive. In the early, jolting days of rail travel, there was “railway spine”, an alleged injury caused by sudden movements. “Slip-and-fallers” have been around for a century: “Banana Annie” carried her own peels for slipping on. One frequent claimant was capable, at will, both of dislocating her bones, and of haemorrhaging. Another regular had the advantage of a neck which, under X-ray, always showed up as broken. During the Depression years the fad was for self-mutilation, with the cleverer claimants managing to cash in from several companies on the basis of one “accidental” amputation. Along the way, Dornstein divertingly investigates the terminology of his subject. The term “ambulance chaser” - originally not the lawyer, but his tout - entered the language in the 1890s and was in common use by 1910. Shyster, to mean a dishonest lawyer, did not come, as is usually believed, from the nefarious activities of Sheuster, a New York attorney; Dornstein has discovered an earlier use and, besides, can find no trace of the existence of Sheuster. Accidentally, on Purpose contains a great deal of information which has never before been assembled, on a topic which has never before been so scrutinised. Dornstein has done prodigious research (his references amount to 70 pages) and does not always resist the temptation to tell us too much. On the other hand the book is clearly written, contains many interesting and obscure facts, and provides an insight into yet another, hitherto secret, crooked world.

Commissioners voted 3-0 to keep the countys subsidy at the current level of $518,957 for Greenwood Village, Colo.-based American Medical Response but to permit AMR to raise its user fees by 12 percent. One year ago, the outlook for New Jerseys commercial real estate market was decidedly bleak. Still, the investment market provided the one bright spot in an otherwise dark picture. Surging capital markets–a reaction to negative returns in the stock market and attractive interest rates–generated a steady flow of money, countering underlying fundamentals. All of these factors, combined with the job growth economists expect to occur during the second half of 2003, have generated cautious enthusiasm among industry players. Throughout the transition of fundamentals, the investment market has continued at a brisk pace. Last year, our group completed $1.2 billion in sales. This year, we are on the same pace as 2002, which is nearly double our typical production.
According to Stanley Simon, SIOR, chief executive officer of Newmark JGT, While there has clearly been a slowdown in the economy, which began before the Sept. 11 tragedy, the commercial real estate markets fundamentals still remain strong, and in fact, have created opportunities for tenants, investors, developers, and service providers. Simon points to the lack of new spec development, a more balanced market for tenants, and moderate price adjustments as key factors n the markets underlying strength. The slowdown in the national economy and depressed corporate earnings have hit the New Jersey commercial real estate market during this first three quarters of 2001, he said. However, these effects have not been dramatic, and pale in comparison to the downturn of the mid 1990s and late 1980s. In fact, the correction in the economy has created a more balanced commercial real estate market for tenants who are finding it easier to relocate or expand within the state. According to Newmark JGT, the trends in the office market in New Jersey in 2001 have been reflected in a moderate decline in average asking rental rates. Meanwhile, the overall vacancy rate has increased due to the negative absorption of more than 2 million SF of space in the New Jersey market, which can be attributed to new sublease space returned as a result of corporate restructuring. Of the more than 20 million SF of office space available, nearly 25% is sublease space. The vacancy rate for space on the market from landlords is well under 10%, a comparatively sound vacancy rate for a suburban office market the size of New Jersey.

All Soil Association-certified birds roam grassland in low density flocks of 500, or up to 2,000 in restricted cases. The EU currently allows as many as 9,000 organic poultry to a shed. Free range birds can be farmed in flocks of up to 12,000, while non- organic hens may be bred in groups of 40,000. Studies show that small flocks reduce stress-related behaviour where chickens pull out each others feathers. The extra land and labour required are reflected in the higher prices.

This emphasizes the lability of the responsiveness of the immune system. We also see here the influence of music. The influence of different types of music has also been extensively studied, with different varieties of music having different effects. We physicians should probably pay attention to the contribution to the healing atmosphere of our waiting rooms by carefully considering the background music.
If anyone should be an inspiration to the legions of non-Latin Europeans dutifully signing on for GCSE salsa classes, Larry Harlow should. The last decade has been spent with his own band touring the world. Last year conga ace Ray Barreto had the idea, inspired by the “fantasy band”, an ad hoc group of jamming jazz stars, of reconvening Harlow, himself, singer Adalberto Santiago and cuatro player Yomo Toro as the Latin Legends Band. Thus Harlow makes his first ever London appearance on Saturday (Barreto is a regular performer and Santiago was here last year). No longer a breath- bating prospect, perhaps, but a most intriguing one.

Granite District last summer was under threat of being divided along east-west lines after the board voted to close two east-side schools. East-side split backers said the school district had grown so large — 68,000 students, Utahs second-largest school district - - that their needs were vastly different from the wests, and their voices largely unheard. The issue is on the back burner, said South Salt Lake City Councilman Bill Anderson, a member of the small school districts coalition.

Real estate lawyers examine and evaluate real property titles, handle real estate sales, purchases and other transactions, foreclose mortgages, represent developers and contractors in drafting and negotiating development and construction agreements, handle real estate financing, structure and draft the governing documents for planned developments such as condominiums, serve as counsel to community and condominium associations, draft and negotiate leases, litigate title, boundary, and other land disputes, and advise clients respecting zoning and land: use matters. The examination of real estate titles requires knowledge of corporations and other forms of business organization, wills, trusts and estates, and a practitioner handling transactions must understand contractual, business, and tax subjects as well. The subjects that are tested on the certification exam attest to this diversity. They are title issues; real estate finance; environmental and land use; condominiums and homeowner associations; landlord tenant; closings; sellers, buyers, brokers, and title insurers; real property litigation; taxation of entities and other tax issues; and ethics. Some hold an impression that at least some aspects of the real estate practice are not challenging, that the practice is increasingly title company, form, and paralegal driven, and that when business is light any lawyer with a good paralegal can Ado real estate closings. Nissan is looking to North America for short-term relief from the Asian flu. “A major goal of Nissans plan to reform its business operations globally is a resurgence of its business in the United States,” says Minoru Nakamura, president of Nissan North America in Torrance, California, who also has served as president of the Tokyobased parent company since October. One way the company will both weather the regional economic storm and become more globally competitive is by rationalizing model designs, Nakamura says. Nissan will reduce its 25 basic vehicle platforms to 14 by 2001 and then to 10 by 2003.
The Board of Directors delegated all the necessary powers to the Chairman of the Board, President and CEO, Carlos Ghosn, to conduct any discussions and negotiations on this matter.

I. INTRODUCTION This study empirically examines person-to-person transactions within the Internet market known as eBay. In this virtual market of unseen participants and products, buyers and sellers face the risks of repudiation, as the counter party may deny the agreement after the fact. Buyers assume risks associated with lack of seller integrity and asymmetric information about the particular product, as the buyer is typically required to send payment before the seller ships the product. In addition, for many eBay transactions, the cost of enforcing a contract is high relative to the transactions value, resulting in a practical absence of legal enforcement. (2) By providing a history of trade execution information, eBay benefits market participants by reducing information asymmetries while achieving substantial transaction cost economies. Market participants relate personal experiences, which eBay uses to calculate a numerical reputation measure for each user. Market participants, in turn, can use this reputation measure to assess counter party risk and adjust bidding behavior accordingly.
E-commerce today is enjoying the fastest growth rate of any business sector because, among other things, it is fast, convenient and cost-effective! A San Diego limousine operator has been named as the Operator of the Year by the International Taxicab Livery Association. Limousines by Linda was chosen last month from hundreds of livery services and taxicab companies in the international group. A press release from the ITLA highlighted the local operators commitment to quality, going as far as to install Global Positioning Satellite systems in all company vehicles. Jon P. Chester, president of Limousines by Linda, founded the company in 1987 after being disappointed with the quality of limousine service in San Diego, said Gaynell Jennings, operations manager for Limousines by Linda. By marketing itself as a boutique ma department store-like market, the, company brings a level of personal service not found at other companies, Jennings said. Other factors in the selection were extensive, preventive maintenance on the vehicles and fax or computer verification of reservations, she said.
Significantly modernizing and expanding the companies fleet of vehicles, introducing a variety of new corporate packages, offering round-the-clock service countywide, and hiring a professional corps of additional chauffeurs are just a handful of the goals currently being implemented at Presidential Limousine, which was acquired out of bankruptcy last month by San Diego businessman John Thill.Thill, who owns several other companies and has been conducting business locally for more than 20 years, said he will improve on the quality service already offered by Presidential, which has been operating in San Diego since 1979 and was recently voted Best Limousine Service in a San Diego Union-Tribune readers poll. During the 1880s and 1890s, L. Prang and Company and other American firms occasionally incorporated colonial themes in the designs of their Christmas cards, [2] but between 1900 and the outbreak of World War I, German publishers largely took over the American market for greeting cards. Their most prominent products were chromolithographed postcards that were well designed, beautifully printed in vibrant colors, and embossed for greater effect. Justly popular, they provided exceptional aesthetic value for trifling cost. World War I brought an embargo on trade with Germany and an end to German domination of the American greeting card market. American publishers new marketing opportunities coincided with the emerging interest in Americas colonial past. Americans once again began sending cards made in the United States for the domestic market. Although Christmas has ancient roots, most scholars agree that the modern Christmas is largely a creation of the nineteenth century. [3] Victorian Britain can claim responsibility for two staples of todays holiday: A Christmas Carol (London, 1843), the compelling tale of spiritual rebirth by Charles Dickens (1816-1870), and the commercial Christmas card, which first appeared in London in the same year. [4] Victorians on both sides of the Atlantic were immensely fond of Christmas cards to judge by the tens of thousands that still survive. By todays standards, however, Victorian Christmas cards were not very Christmassy. Seasonal and religious images were in the minority, and the most common subjects were summer flowers, followed by a profusion of other subjects. [5] In the early twentieth century, card publishers began to standardize or conventionalize Christmas card imagery. Most of the cards sold today are variations on themes introduced seventy to eighty years ago.

Lear Corporation and BERU Group said they have signed an agreement to jointly design and develop tire pressure monitoring systems for the global automotive market. Terms were not disclosed. Under this strategic partnership, the two companies said they will develop systems that will relay information to drivers through the electronic architecture used for the remote keyless entry system. This strategic partnership makes sense from a technological standpoint because both remote keyless entry systems and tire pressure monitoring systems currently operate on radio- frequency signals, says D. William Pumphrey, President of the Lear Electronics and Electrical Division. This partnership is especially important in North America because the recently amended United States Transportation Recall Enhancement Accountability and Documentation (TREAD) Act will require tire pressure warning systems on all new vehicles by 2003. Nursing home care in Utah is improving, the Centers for Medicare and Medicaid Services reported Wednesday. Many of those improvements were linked directly by care center administrators to a quality improvement project through HealthInsight, Medicares Quality Improvement Organization in Utah. The organization is part of the national Nursing Home Initiative, which focuses on raising standards of care in nursing homes across the country and giving consumers more comparison information.

It would not be surprising in the light of the consultation by the British Dental Association which found that 59% of dentists were planning to either cut their work for the NHS or quit the NHS in protest at what the Government describes as the most radical shake-up of the profession since 1948. Only 2% of dentists said they would increase the amount of NHS work they did on the back of the Governments proposals. A worrying 16% said they would stop providing NHS dentistry altogether.

Outside readings on current managed competition proposals would augment the textbook discussion well.A short section on the economic effects of information asymmetries in the medical care and health insurance market introduces the concepts of supplier induced demand and adverse selection. Both discussions are short, but the portion on adverse selection especially needs expansion. More rigor, explanatory graphs, and a more extensive bibliography would make the adverse selection concept more useful. This topic is critical to a sound understanding of the functioning of medical expense insurance.The final section deals with value judgments and evaluative economics. The nontechnical explanation of efficiency versus fairness criteria for evaluating medical care policy is somewhat cursory. More technical material is needed to improve the precision of this discussion. However, even without any additions, the text provides a general background on issues of access to medical care, affordability, and quality of care. The difficulty of making allocation decisions given scarce resources is clearly laid out and opens the way for a discussion of policy alternatives.

Limousine has diverse meanings, from an inhabitant of the region around Limoges, once called Limousin, and which in the 18th century was looked at askance as home to “an old barbarous French, formerly brought into this country out of France”. As Volkswagen and BMW reached a settlement on taking over Rolls brands, Daimlers management board gave the go-ahead for production of the Maybach, which it has previewed at auto shows for the past year. “With the positive decision for the production of the Mercedes- Benz Maybach, we are underscoring once more our claim to represent the absolute top in every market segment,” said Daimler chief executive Mr Jurgen Schrempp.

The hold-ups are a matter of life and death for desperate people who have been diagnosed with cancer of the breast, colon or lung, or with a brain tumour. Doctors are furious that drugs such as Avastin, which is used to treat colon cancer, and Ce-tuximab, a treatment for head and neck cancers, are being blocked by the National Institute for Clinical Excellence (Nice), a government-appointed quango set up to decide which drugs should be routinely prescribed on the NHS.

A high-calibre panel of judges has picked the winners in the Huddersfield Examiner Business Awards. The five-strong panel sifted through hundreds of entries to find the winners of 10 categories recognising the achievements of local firms of all types and sizes. The judges include John Thompson, who is professor of entrepreneurship at Huddersfield University. Prof Thompson has worked extensively in the field of incubating new businesses - pioneering the Huddersfield Business Generator, based at The Media Centre, Northumberland Street, and the universitys Business Mine.

ACCORDING TO ANALYSIS BY CUSHMAN Wakefield of New Jersey Inc., East Rutherford, New Jersey, industrial real estate market fundamentals in northern and central New Jersey have shown signs of improvement. At the end of third-quarter 2003, the amount of overall available space had fallen 9.1 percent from third-quarter 2002 to rest at 44.6 million square feet. According to Stan Danzig, an executive director with Cushman Wakefield, New Jersey rents have held steady and are ready to begin heading upward, creating opportunities for companies that are ready to expand or consolidate. Speculative space in New Jersey currently accounts for 1.1 million square feet of new construction. With supply continuing to outpace demand, the only new construction starts in the near term will be build-to-suits, said Frank Caccavo, an executive director with Cushman Wakefield.
In a transaction arranged by Newmark Company Real Estate of New Jersey, Emcore Corporation, a computer chip manufacturer, has purchased a 74,850 SF office facility at 394 Elizabeth Ave. in Somerset, N.J. The Newmark team of Seena Stein, president, Richard Madison, managing director, and Jane Greenblatt, senior managing director, along with James Kuhn and David Noonan, of the firms New York office, brokered the $4.5 million sale. In contrast to other commercial real estate markets throughout the country, the New Jersey commercial real estate market remains relatively strong. CameraFrom the simplest amateur camera to the most complex, professional piece of equipment, all cameras have five common parts. The lens is made of glass or plastic (or groups of glass elements) and focuses light passing through it on the film to reproduce an image. The diaphragm is an opening or aperture that controls the amount of light entering the camera from the lens and so limits the films exposure to light. The diaphragm ranges in complexity from a fixed lens, opening in a simple camera, to apertures that can be adjusted manually or automatically.The three remaining parts common to all cameras are incorporated in the camera body (also called a chassis or housing). The shutter also limits the films exposure to light by controlling the length of time the film is exposed. Shutter speed can be adjusted in many cameras to suit light conditions and the photographic subject matter; moving objects can be frozen on film with fast shutter speeds. The camera body encloses and protects the operating parts of the camera, including a light meter, the film transport system, built-in flash, the reflex viewing system, and electronic and mechanical components. The body must be lightproof, durable, and resistant to environmental changes. The viewfinder is a specialized lens the photographer uses to preview the photograph either through the lens, if the camera is a reflex-type, or in a separate view for simpler cameras.
All the major brands, from Nikon to Canon and Pentax to Sony, offer point-and-shoot digital cameras. Even Hewlett-Packard has jumped on the digital camera bandwagon. According to Justin Porterfield, manager of the ZCMI Center Inkleys, the cost ranges from $100 to $1,000. One in the $500-price range will get you near single lens reflex quality, he said. According to Allred, most digital cameras have a small LCD monitor on the back that is ideal for composing and reviewing images. It also lets you magnify the images to check for accurate focus and small details. Most digital cameras use compact flash type I memory cards that allow easy downloading to a computer or printer through a USB port on the camera. This allows easy transmission of photographic data to a PC or Mac. Most digital cameras can record movies in AVI format with a duration of up to 30 seconds. The low-quality movies are really for e-mailing and not for television viewing.

Moderately priced models that can be merchandised in a self-service manner are the primary volume producers. Real estate practice is a broad and widely defined area of the law. In a pristine sense it deals with the esoteric subject of real property law and titles. In practice the subject matter handled by real property lawyers is much broader. Many of the areas of law within real estate practice are areas of specialty themselves. Real estate lawyers examine and evaluate real property titles, handle real estate sales, purchases and other transactions, foreclose mortgages, represent developers and contractors in drafting and negotiating development and construction agreements, handle real estate financing, structure and draft the governing documents for planned developments such as condominiums, serve as counsel to community and condominium associations, draft and negotiate leases, litigate title, boundary, and other land disputes, and advise clients respecting zoning and land: use matters. The examination of real estate titles requires knowledge of corporations and other forms of business organization, wills, trusts and estates, and a practitioner handling transactions must understand contractual, business, and tax subjects as well. The subjects that are tested on the certification exam attest to this diversity. They are title issues; real estate finance; environmental and land use; condominiums and homeowner associations; landlord tenant; closings; sellers, buyers, brokers, and title insurers; real property litigation; taxation of entities and other tax issues; and ethics. Some hold an impression that at least some aspects of the real estate practice are not challenging, that the practice is increasingly title company, form, and paralegal driven, and that when business is light any lawyer with a good paralegal can Ado real estate closings. This impression is not accurate. As with any area of practice, successfully representing clients in real estate matters requires knowledge, skill, and experience. The diversity in real estate practice may mean that no one lawyer can be an expert in each practice area encompassing the modern real property practice or that are tested by the certification program. The committee recognizes that few lawyers are likely to possess specific and detailed expertise in each of the many subjects that fall within the scope of real estate.

Pocket gophers are fossorial (burrowing) rodents–so named because they have fur-lined pouches outside the mouth, one on each side of the face. These pockets, which are capable of being fumed inside out, are used for carrying food. Pocket gophers are powerfully built in the forequarters and have a short neck; the head is fairly small and flattened. The forepaws are large-clawed and the lips close behind large incisors. This feature allows them to use their incisors for digging without getting a mouthful of dirt, a unique feature to gophers. There are over 30 species of pocket gophers in the Western Hemisphere. Pocket gophers vary in size from 5 1/2 inches in length to over 13 inches in length. Litter sizes vary from one to 10 but typically average three to four. In the northern part of their range they have one litter per year, as opposed to up to two in the southern ranges. Young gophers are dispersed above ground and are capable of swimming as well on the search for suitable habitat to begin new burrow systems. Pocket gophers feed in three ways: they feed on roots, above-ground vegetation, and they pull vegetation into their tunnel to be stored in food caches for later consumption. In the vineyard, pocket gophers girdle vines, damage roots systems (most often in new plantings), and cause multiple-irrigation problems by promoting erosion and damaging drip lines. They are solitary little beasts, vigorously maintaining and defending their tunnel system. Depending on the species and available habitat, gopher population density may vary from six to eight per acre, to up to 62 per acre. Gophers do not hibernate and only cohabitate during the breeding season The burrowing activity of one gopher produces up to 70 mounds in one month. So how do you control such an active but solitary rodent? The fact that a gopher is solitary works to your advantage. You have three basic pest management tools for gopher control: Biological control, chemical control and trapping.
Happily, there exists a simple, less dramatic and more effective system of pest control, called Integrated Pest Management, or IPM, which employs least-toxic strategies. IPM has three parts: sanitation, exclusion, and baits, says Bill Quarles of the Biointegrated Resource Center (BIRC) in Berkeley, California. Here are some tips from BIRC and the book Tiny Game Hunting to help you manage (i.e., destroy) the uninvited: * They come looking for food and water. Never leave food out. Wash dishes promptly, keep surfaces clean, put garbage in pails with snug-fitting lids and take it out often. When you do not give pests anything to eat, it forces them to eat the baits, Quarles says. Wipe up moisture and fix any leaks. * Exclude pests by sealing cracks and crevices, especially around pipes and radiators and between counters, baseboards, and walls, with steel wool (mice cant chew through) or a low- or no-VOC caulk, which wont release toxic volatile organic compounds into your air. Put out sticky traps so that you know where roaches are–how they get in, where they are living, Quarles advises. To kill roaches, treat crevices with boric acid (see below) before caulking.

The reason for this is three-fold; financial services firms are moving in to take advantage of excellent transportation between Northern New Jersey and Wall Street; high-tech companies have found New Jersey a friendly environment; and many current New Jersey tenants are expanding within the market.Northern New Jerseys availability rate remained steady, rising to 13 percent from 12.9 percent at 1997s year end. This minimal rise reflects the markets strength, despite a deluge of space coming available (over 4 million square feet) and increasing pressure from New York to keep large tenants from leaving the city.Central New Jersey performed with equal, vigor as its availability rate declined to 12.9 percent from 15 percent, offsetting the 2.5 million square feet of inventory that came on in the first six months of 1998.
